While many people think just using TM next to a name or other item will automatically trademark that item. It is much more. Practically anything is capable of functioning as a trademark, including a word, a phrase (“WHERE’S THE BEEF” OR “JUST DO IT”), a letter or letters (LV for Louis Vuitton on purses, pocketbooks and luggage), a number or series of numbers, a pictorial scene, a smell (a new fragrance that is unique), a sound (like many jingles you now know from commercials), a color (red on bottom of women’s shoes), packaging, (a unique box or labels on a cola can) and product configurations (the shape or unique design).
